中华人民共和国政府和牙买加政府关于牙买加在中华人民共和国香港特别行政区保留名誉领事馆的协定

中华人民共和国政府和牙买加政府（以下简称“缔约双方”），本着发展两国之间友好关系和加强两国之间领事关系的共同愿望，就牙买加在中华人民共和国香港特别行政区保留名誉领事馆问题达成协议如下：

一、中华人民共和国政府同意牙买加政府在中华人民共和国香港特别行政区保留名誉领事馆，领区为香港特别行政区。

二、名誉领事应在《维也纳领事关系公约》和中华人民共和国香港特别行政区有关法律和规定的范围内执行领事职务并享有相应的特权与豁免。

三、中华人民共和国政府根据中国有关法律和规定和《维也纳领事关系公约》，为牙买加驻中华人民共和国香港特别行政区名誉领事馆及其名誉领事官员执行领事职务提供必要的协助和便利。

四、双方将本着协商合作的精神，根据《维也纳领事关系公约》和国际惯例，友好地处理两国间的领事问题。

五、名誉领事可以是缔约双方公民或第三国公民，但不得是无国籍者，且必须是中华人民共和国香港特别行政区永久性居民。

六、牙买加向香港特别行政区委派职业领事后不得再委派名誉领事。

七、本协定自一九九七年七月一日起生效。

本协定于一九九七年五月二十九日在金斯敦签定，一式两份，每份都用中文和英文写成，两种文本同等作准。

AGREEMENT BETWEEN THE GOVERNMENT OF JAMAICA and THE GOVERNMENT OFTHE PEOPLE"S REPUBLIC OF CHINA CONCERNING THE MAINTENANCE BY JAMAICA OFTHE CONSULAR POST HEADED BY AN HONORARY CONSUL IN THE HONG KONG SPECIALADMINISTRATIVE REGION OF THE PEOPLE"S REPUBLIC OF CHINA

The Government of Jamaica and the Government of the People"s Republicof China (hereinafter referred as "the two Parties"), out of the commondesire to develop friendly relations and enhance consular ties between thetwo countries, have reached the following agreement concerning themaintenance by Jamaica of the consular post headed by an Honorary Consulin the Hong Kong Special Administrative Region of the People"s Republic ofChina:

1. The Government of the People"s Republic of China agrees to themaintenance by the Government of Jamaica of the consular post headed by anHonorary Consul in the Hong Kong Special Administrative Region of thePeople"s Republic of China, with the Hong Kong Special AdministrativeRegion as its consular district.

2. The Honorary Consular Officers shall exercise the consularfunctions in accordance with the Vienna Convention on Consular Relationsand the relevant laws and regulations of the Hong Kong SpecialAdministrative Region of the People"s Republic of China, and enjoy thecorresponding privileges and immunities.

3. The Government of the People"s Republic of China, in accordancewith its relevant laws and regulations and the Vienna Convention onConsular Relations, shall accord, the necessary assistance and facilitiesto the consular post headed by an Honorary Consul of Jamaica and itsHonorary Consular Officers in the Hong Kong Special Administrative Regionof the People"s Republic of China in the exercise of its consularfunctions.

4. The two Parties shall handle consular matters between them in afriendly manner in the spirit of consultation and cooperation, and inaccordance with the Vienna Convention on Consular Relations andinternational practice.

5. The Honorary Consular Officers shall be the nationals of eitherParty or a third country, but not the stateless, and must be permanentresidents ofthe Hong Kong Special Administrative Region of the People"sRepublic of China.

6. Jamaica shall not appoint any Honorary Consular Officers, once ithas appointed career consular officers to the Hong Kong SpecialAdministrative Region of the People"s Republic of China.

7. The present Agreement shall enter into force on 1997 July 01.

Done in Kingston this 1997 (year) 05 (month) 29 (day) in duplicate inthe Chinese and English languages, both texts being equally authentic.
