中华人民共和国政府与汤加王国政府关于将汤加王国驻香港名誉领事馆改为“汤加贸易办事处”的协定

中华人民共和国政府和汤加王国政府就汤加王国驻香港名誉领事馆改为“汤加贸易办事处”达成协议如下：

一、中华人民共和国政府同意，自一九九七年七月一日起，汤加王国驻香港名誉领事馆改为“汤加贸易办事处”（以下简称“办事处”），设于中华人民共和国香港特别行政区。

二、“办事处”主要职责是促进双方在贸易、文化、旅游等领域的发展与合作交流。

三、“办事处”可以汤加王国驻旧金山总领事馆名义行使下列领事职能：

（一）为驻在国和第三国公民颁发签证；

（二）办理本国官员护照、普通护照的换发、补发、延期和加注等事项；

（三）办理公证、认证事宜。

办理上述事宜时，签发地一律填写旧金山。

四、“办事处”办公地点、首长寓所和执行公务时使用的交通工具均不悬挂国旗和国徽，其正式函件中均不带有这类标记；“办事处”及其工作人员的公用或自用车辆，使用普通牌照；其工作人员不使用领事官衔，不登入外国驻港官方机构名册。

五、“办事处”及其工作人员应遵守中华人民共和国（包括香港特别行政区）的法律和规章，不得从事与其设立目的和职能不相符的活动。

六、中华人民共和国政府根据中国有关法律和规定，为“办事处”履行公务提供必要的协助和便利，并采取必要措施，保护“办事处”不受侵犯或损害。

七、“办事处”可在香港特别行政区收取派遣国法律规章所规定的与其履行公务有关的办事规费与手续费，并免缴纳上述收费的一切捐税。

八、本协定自一九九七年七月一日起生效。

本协定于一九九七年六月五日在香港签订，一式两份，每份都用中文和英文写成，两种文本同等作准。

AGREEMENT BETWEEN THE GOVERNMENT OF THE PEOPLE"S REPUBLIC OF CHINAAND THE GOVERNMENT OF THE KINGDOM OF TONGA CONCERNING THE CHANGE OF THECONSULAR POST HEADED BY AN HONORARY CONSUL OF THE KINGDOM OF TONGA IN HONGKONG TO THE "TONGA TRADE OFFICE"

The Government of the People"s Republic of China and the Government ofthe Kingdom of Tonga have reached the following agreement concerning thechangeof the consular post headed by an honorary consul of the Kingdom ofTonga in Hong Kong to the "Tonga Trade Office":

1. The Government of the People"s Republic of China agrees to thechange, with effect from 1 July 1997, of the consular post headed by anhonorary consul of the Kingdom of Tonga in Hong Kong to the "Tonga TradeOffice" (hereinafter referred to as "the Office"), which shall be seatedin the Hong Kong Special Administrative Region of the People"s Republic ofChina.

2. The main responsibility of the Office will be to promote thedevelopment, cooperation and exchanges between the two countries in thefields of trade, culture and tourism.

3. The Office shall perform the following consular functions on behalfof Consulate General of the Kingdom of Tonga in San Francisco:

(1) Issuing visas to nationals of the country in which the Office islocated and of a third country;

(2) Handling the replacement, reissue, renewal and endorsement ofofficial or ordinary passports of its own country;

(3) Handling matters concerning notarization and legalization.

While the Office handles the above-mentioned matters, the place ofissuance shall always be San Francisco.

4. The chancellery of the Office, the residence of its head and itsmeans of transport used for official business shall not fly the nationalflag or display the national emblem, nor shall its official letters bearsuch signs. The vehicles of the Office and its staff for official orprivate uses shall useordinary car plates. The staff of the Office shallnot use consular titles, nor shall it be included in the list of officialforeign institutions in Hong Kong.

5. The Office and its staff shall observe the laws and regulations ofthe People"s Republic of China (including the Hong Kong SpecialAdministrative Region), and shall not engage in activities incompatiblewith the purpose of establishing the Office and its responsibility andfunctions.

6. The Government of the People"s Republic of China shall, inaccordance with its relevant laws and regulations, accord necessaryassistance and facilities to the Office in the performance of its officialduties, and shall take such steps as may be necessary to protect theOffice against any intrusion ordamage.

7. The Office may levy in the Hong Kong Special Administrative Regionfees and charges as provided by the laws and regulations of the sendingCountry relating to the performance of its official duties, and the sumscollected in the form of the above-mentioned fees and charges shall beexempt from all taxes.

8. The present Agreement shall enter into force on 1 July 1997.
