我与加纳共和国政府已于一九九七年五月二十九日签署《中华人民共和国政府和加纳共和国政府关于中华人民共和国香港特别行政区与加纳共和国互免签证的协定》。现送上协定副文(中、英文),请予备案。协定正本已存外交部。

中华人民共和国政府和加纳共和国政府关于中华人民共和国香港特别行政区与加纳共和国互免签证的协定

中华人民共和国政府和加纳共和国政府(以下简称“缔约双方”),为了发展两国的友好关系,促进中华人民共和国香港特别行政区和加纳共和国之间的经济和贸易的发展,便利人员往来,通过友好协商,就中华人民共和国香港特别行政区和加纳共和国之间的互免签证问题议定如下:

第 一 条

中华人民共和国公民持有效的中华人民共和国香港特别行政区护照入、出或途经加纳共和国,免办签证;加纳共和国公民持有效的加纳共和国护照(包括使用同一本护照的偕行人)入、出或途经中华人民共和国香港特别行政区,免办签证。

第 二 条

一、本协定第一条所述双方持照人,在对方境内逗留期间,应遵守其有关法律和规章。

二、本协定第一条所述双方持照人,如在对方境内欲逾免签期限,应依照对方主管机关的规定办理有关手续。

第 三 条

本协定不限制中华人民共和国香港特别行政区政府和加纳共和国政府的如下权力:拒绝不受欢迎或不可接受的对方人员进入自己管辖区内或者终止其在该管辖区内的逗留,并无须说明理由。

第 四 条

由于国家安全、社会秩序、公共卫生等原因,缔约双方均可临时中止实施本协定的全部或者部分条款,但在采取或者取消上述措施前,缔约一方应当及时通过外交途径通知缔约另一方,并自对方收到通知之日起生效。

第 五 条

一、缔约双方应当自本协定签字之日起三十日内,通过外交途径交换本协定第一条所述护照样本。

二、缔约一方如更新上述护照式样,应当提前三十日通过外交途径通知缔约另一方,并提供新护照样本。

第 六 条

一、本协定自一九九七年七月一日起生效。

二、本协定无限期有效。缔约一方如要求终止本协定,应通过外交途径书面通知缔约另一方。本协定自通知之日起第九十日失效。

三、缔约双方经协商,可通过适当方式补充或修改本协定。

第 七 条

自一九九七年七月一日起,中华人民共和国中央人民政府授权香港特别行政区政府执行本协定。

本协定于一九九七年五月二十九日在北京签订,一式两份,每份分别用中文和英文写成,两种文本同等作准。

AGREEMENT BETWEEN THE GOVERNMENT OF THE REPUBLIC OF GHANA AND THEGOVERNMENT OF THE PEOPLE"S REPUBLIC OF CHINA ON MUTUAL EXEMPTION OF VISAREQUIREMENTS BETWEEN THE REPUBLIC OF GHANA AND THE HONG KONG SPECIALADMINISTRATIVE REGION OF THE PEOPLE"S REPUBLIC OF CHINA

The Government of the Republic of Ghana and the Government of thePeople"s Republic of China (hereinafter referred to as the two ContractingParties),with a view to developing friendly relations between the twocountries, promoting trade and economic development and facilitatingpersonnel exchanges between the Republic of Ghana and the Hong KongSpecial Administrative Region of the People"s Republic of China, have,through friendly consultations, reached agreement on mutual exemption ofvisa requirements between the Republic of Ghana and the Hong Kong SpecialAdministrative Region of the People"s Republic of China as follows:

Article I

Citizens of the Republic of Ghana, who are holders of valid passportsof the Republic of Ghana (including the accompanying persons who share thesame passport of the holder), shall be exempted from visa requirements forentry into, exit from or transit through the territory of the Hong KongSpecial Administrative Region of the People"s Republic of China asvisitors; Citizens of the People"s Republic of China, who are holders ofvalid passports of the HongKong Special Administrative Region of thePeople"s Republic of China shall be exempted from visa requirements forentry into, exit from or transit through the territory of the Republic ofGhana as visitors.

Article II

1. The passport holders referred to in Article I shall abide by therelevant laws and regulations of the other Contracting Party during theirstay in its territory.

2. The passport holders referred to in Article I shall go through therelevant procedures in accordance with the regulations of the competentauthorities for stay in the territory of the other Contracting Party ifsuch a stay would exceed the valid period of visa exemption.

Article III

This Agreement does not restrict the right of the Government of theRepublic of Ghana and the Government of the Hong Kong SpecialAdministrative Region of the People"s Republic of China to prohibitpersonae non grata or unacceptable persons of the other Contracting Partyfrom entering its territory or toterminate their stay in its territorywithout citing reasons therefor.

Article IV

Either Contracting Party may temporarily suspend the implementation ofthis Agreement partly or wholly on grounds of national security, socialorder and public health. However, the other Contracting Party shall benotified in advance of such suspension of the Agreement and its subsequentrelease through diplomatic channels, and the suspension and release shallenter into force upon the day of that notice.

Article V

1. The Two Contracting Parties shall complete the exchange of samplesof their passports referred to in Article I within 30 days of the signingof this Agreement through diplomatic channels.

2. Either Contracting Party, in case of any change of the forms of itspassports, shall inform the other Contracting Party, through diplomaticchannels, 30 days in advance and furnish it with samples of new passports.

Article VI

1. This Agreement shall enter into force on 1 July 1997.

2. This Agreement shall remain valid for an indefinite period of time.If either Contracting Party wishes to terminate this Agreement, it shallnotifythe other Contracting Party in writing through diplomatic channels.This Agreement shall cease to be effective on the ninetieth day after thedate of thatnotice.

3. Additional clauses or amendments to this Agreement may be made, asappropriate, by the two Contracting Parties after consultations.

Article VII

The Central People"s Government of the People"s Republic of Chinashall, with effect from 1 July 1997, authorize the Government of the HongKong Special Administrative Region to implement this Agreement.

Done in Beijing on May 29, 1997 in duplicate in the English andChinese languages, both texts being equally authentic.
