2006.8.1入职这家公司时,试用期三个月,2006.11.1开始签定正式合同,合同期为一年,协商好工资待遇,并以邮件的形式确认了工资金额,并由邮件确认,其中分两部分:一部分基本工资,按月发放;一部分浮动工资,按季度发放,并写明发放比例。但是劳动合同中并未签署浮动工资比例,只有写到有浮动工资。入职公司快一年啦,每次都未足额发放浮动工资,合同未满一年,2007.10该公司与另一些股东合同开办一新公司,将我调入新公司,原公司以离开公司为由,不发放浮动工资。这样我是否可以仲裁,需要提供哪些有力证据证明,仲裁事由应该如何写?

    Your compensation during the probation period will be RMB2,500/month, which is inclusive of income tax. After the probation period, your total potential annual compensation will be
    RMB 51,428 / year inclusive of personal income tax. The potential total annual compensation will consist of two parts, 70% (RMB36,000/year) is fixed compensation and the other
    30% (RMB15,428 /year) will be variable compensation. The fixed compensation is guaranteed by the company and is payable to the Employee pro-rata monthly.The variable compensation can be less, equal or more than the indicated number above depending on 1) the overall company performance; 2) the personal performance indices set forth by the company and will be paid quarterly. The pay structure and the written performance indices will be explained and will form an appendix in the employment contract.
    因为他上面写的待遇也是大概的待遇,但是这刚刚接近当时口头谈的我要求的最低待遇,我看到年总收入,当时就没太计较措词。
